By downloading, installing, or using the Tiny Moments baby tracker application ("Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

Tiny Moments is a mobile application designed to help parents and caregivers track their baby's activities, development, and milestones. The Service includes features such as:

• Activity tracking (feeding, sleep, diaper changes, etc.)
• Growth and development monitoring
• Photo and video storage
• Family sharing capabilities
• Milestone recording and reminders
• Data export and backup features

3. User Accounts

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

4. Eligibility

By creating an account, you represent that you meet this minimum age requirement. If we learn that we have collected personal information from a child under this age, we will take steps to delete the information as soon as possible.

9. Subscription and Payment Terms

Certain features of the Service may require a paid subscription. If you choose to purchase a subscription:

• Subscriptions automatically renew unless cancelled
• You can cancel your subscription at any time through your account settings
• Payments are non-refundable. Any refunds or credits will be handled in accordance with the terms of the relevant app store from which you made the purchase.

The Service and its original content, features, and functionality are owned by Tiny Moments Studio and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service.

11. Disclaimer of Warranties

The Service is provided "as is" without warranty of any kind. We disclaim all warranties, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

12. Medical Disclaimer

Tiny Moments is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or medical condition. The information provided by the Service is for tracking purposes only and should not replace professional medical advice. Always consult with healthcare professionals regarding your baby's health and development.

13. Limitation of Liability

To the maximum extent permitted by law, Tiny Moments Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.

14. Indemnification

You agree to defend, indemnify, and hold harmless Tiny Moments Studio from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from your use of the Service or violation of these Terms.

15. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason in our sole discretion. You may also delete your account at any time through the app settings.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in San Francisco County, California.

17. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. Your continued use of the Service after the effective date of any changes constitutes acceptance of the new Terms.

18. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. The invalid or unenforceable provision will be replaced with a valid provision that most closely matches the intent of the original provision.
